Protecting your private information is our priority. This Statement of Privacy applies to the Subbey app, Subbey LLC, and Subbey Inc. (collectively the “Company” or “Subbey”), and governs data collection and usage. For the purposes of this Privacy Policy, unless otherwise noted, all references to the Company or Subbey include Subbey LLC, Subbey Inc., https://www.subbey.com and the Subbey app. The Subbey application is a substitute teaching app that transforms the way K-12 schools and other organizations manage their staffing needs. With Subbey, teachers and administrators can send notifications within private organizations to fill vacant roles in minutes, saving valuable time and ensuring continuity of learning. By using the Subbey application, you consent to the data practices described in this Statement.
Collection of your Personal Information
In order to provide products and services, Subbey may collect personally identifiable information, including but not limited to your first and last name, email address, phone number, place of employment, and job title.
We do not collect any personal information unless you voluntarily provide it. However, you may be required to provide certain information when you elect to use certain products or services. These may include: (a) registering for an account; (b) entering a sweepstakes or contest sponsored by us or one of our partners; (c) signing up for special offers from selected third parties; (d) sending us an email message; or (e) submitting your credit card or other payment information when purchasing products or services. We will use your information for, but not limited to, communicating with you in relation to services and/or products you have requested. We may also gather additional personal or non-personal information in the future.
Use of your Personal Information
Subbey collects and uses your personal information to operate and deliver the services you request. Subbey may also use your personally identifiable information to inform you of other products or services available from Subbey and its affiliates..
Sharing Information with Third Parties
Subbey does not sell, rent, or lease customer lists to third parties.
Subbey may share data with trusted partners to perform statistical analysis, send communications, provide customer support, or arrange deliveries. All such third parties are prohibited from using your personal information except to provide these services to Subbey, and they are required to maintain confidentiality.
Third-Party Disclaimer: Subbey may rely on third-party service providers (such as hosting, analytics, or communication platforms). While we select reputable providers, Subbey is not responsible for the actions, omissions, or security practices of these third parties.
Disclosure for Legal or Safety Reasons
Subbey may disclose your personal or institutional information, without notice, if required to do so by law or when we believe in good faith that such action is necessary to: (a) comply with legal process or applicable law; (b) protect and defend the rights or property of Subbey; (c) protect the safety of Subbey users or the public; or (d) respond to lawful requests by public authorities, including to meet national security or law enforcement requirements.
Responsibility for User-Provided Content
Subbey is not responsible for the accuracy, legality, or appropriateness of any information entered into the platform by customers or their users. All such information remains the sole responsibility of the customer or user who provided it.
Right to Deletion
Subject to the exceptions set out below, upon receipt of a verifiable request, we will delete your personal information from our records and direct service providers to do the same.
Please note we may not be able to comply with requests to delete your personal information if it is necessary to:
- Complete the transaction for which the personal information was collected or otherwise perform a contract between you and us;
- Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible;
- Debug to identify and repair errors that impair functionality;
- Exercise free speech or comply with law;
- Comply with the California Electronic Communications Privacy Act;
- Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest, if deletion would seriously impair that research, provided we have obtained your consent;
- Enable solely internal uses reasonably aligned with your expectations; or
- Comply with an existing legal obligation.
Children Under Thirteen
Subbey does not knowingly collect personally identifiable information from children under the age of 13. If you are under 13, you must ask your parent or guardian for permission to use this application.
E-mail Communications
From time to time, Subbey may contact you via email for announcements, promotional offers, alerts, confirmations, surveys, and/or other communications. To improve our services, we may receive a notification when you open an email from Subbey or click on a link.
You may opt out of marketing or promotional communications by sending an email request to shea.mcgee@subbey.com.
Limitation of Liability
To the maximum extent permitted by law, Subbey and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising from or related to your use of the platform.
Indemnification
Customers agree to indemnify and hold harmless Subbey against any claims, damages, or liabilities arising from the customer’s misuse of the platform or failure to comply with applicable laws.
Changes to this Statement
Subbey reserves the right to modify this Privacy Policy at any time. We will notify you of significant changes by sending a notice to the primary email address specified in your account, by placing a prominent notice on our application, and/or by updating this page. Continued use of the platform after modifications constitutes your acknowledgment of the modified Privacy Policy and agreement to be bound by it.
